iPiata Terms and Conditions of Use

This document constitutes the Terms and Conditions of Use of the iPiata platform (ipiata.ro), operated by BANA RARES-NICOLAE AUTHORIZED NATURAL PERSON (PFA), commercial name iPiata, VAT/CIF RO33388821, registration no. F2014000987292, professional address: Str. Natiunii no. 65, Ploiesti, Prahova, Romania, email: [email protected].

By accessing or using the platform, the user fully accepts these terms.

1. Applicable Legal Framework

iPiata operates in compliance with: Romanian Law no. 365/2002 on electronic commerce and Directive 2000/31/EC; Regulation (EU) 2022/2065 (DSA); Regulation (EU) 2019/1150 (P2B); Regulations (EC) no. 178/2002, 852/2004, 1169/2011 on food safety and labelling; GEO no. 34/2014 and Directive 2011/83/EU; Law no. 449/2003; Law no. 193/2000; Law no. 363/2007; GDPR (Regulation (EU) 2016/679); Directive (EU) 2015/2366 (PSD2); Law no. 8/1996.

2. Service Description

iPiata is an intermediary marketplace platform. Sellers list food products; buyers purchase them. iPiata is not the producer, direct seller, or shipper of any listed product.

3. User Accounts

  • Each user may hold one main account; duplicate accounts may be suspended
  • Registration information must be accurate, complete, and up to date
  • Password security and credential confidentiality are the user responsibility
  • iPiata may suspend or delete accounts that breach these terms or applicable law

4. Seller Obligations

  • Compliance with all applicable food regulations (Regulations (EC) 178/2002, 852/2004, 1169/2011; Law 150/2004)
  • Holding all required sanitary, veterinary, and commercial authorisations
  • Displaying accurate, truthful, and non-misleading descriptions, photos, and prices
  • Updating stock in real time and fulfilling confirmed orders
  • Issuing fiscal documents per the seller applicable tax regime (Fiscal Code)

5. Buyer Obligations

  • Providing accurate and complete delivery data
  • Availability at the delivery address during the communicated time window
  • Checking products on receipt and reporting issues within 24 hours
  • Full payment at the time of order placement

6. Payments and Commissions

Payments are processed by third-party providers (Stripe) under PSD2 (Directive (EU) 2015/2366). A platform commission is automatically retained from each completed transaction.

7. Returns and Withdrawal Rights

The right of withdrawal does not apply to perishable food products under art. 16(d) of GEO no. 34/2014. Non-conforming or damaged products may be returned per the Right of Withdrawal procedure.

8. Liability and Limitations

iPiata is not liable for product quality, safety, or conformity. Direct product liability rests exclusively with the seller. Joint platform liability applies only under conditions expressly provided by DSA or applicable law.

9. Intellectual Property

Platform content is protected under Law no. 8/1996. Unauthorised copying or commercial use is prohibited. User-uploaded photos and descriptions remain the user property; the user grants the platform a licence for promotional use.

Personal data is processed under GDPR (Regulation (EU) 2016/679) and applicable Romanian law. See the Privacy Policy.

11. Dispute Resolution

Consumers may seek resolution through: ANPC - anpc.ro; EU ODR Platform - ec.europa.eu/consumers/odr; competent Romanian courts.

12. Modifications

iPiata may modify these terms with at least 15 days advance notice before entry into force, per art. 9 of Regulation (EU) 2019/1150.

13. Governing Law

These terms are governed by Romanian law and applicable EU regulations. Any dispute is subject to the jurisdiction of Romanian courts.
